Camellia Labs — AI Skincare Personalization App

Applies to: Your use of the Camellia Labs mobile application and related services (the “App”)
These Terms and Conditions (“Terms”) are a binding agreement between you and Camellia Labs (“Camellia,” “we,” “us,” or “our”) governing your access to and use of the App. By tapping “I agree,” creating an account, or otherwise using the App, you accept these Terms. If you do not agree, do not use the App.
These Terms incorporate by reference our Privacy Policy, our Consumer Health Data Privacy Policy, and our Biometric Data Retention and Destruction Policy. Please read all of them.
Before you can proceed, you must confirm that you are 18 or older. We use a neutral age gate to verify eligibility. The date of birth you enter is used only to confirm your age and is not stored; it is evaluated in memory and discarded immediately after the check. If you are under 18, you may not use the App, and we will not retain any information from your session. By using the App, you represent and warrant that you are 18 or older and that the eligibility information you provide is accurate.
The App uses artificial intelligence to analyze information you provide about your skin, including optional facial photos, self-reported skin details, and related inputs, to generate a personalized skin assessment and routine recommendations. You may choose to upload photos over time to track changes in your skin. Use of photo analysis is optional; you can receive a routine based on self-reported information alone.
The App is not a medical device and does not provide medical advice, diagnosis, or treatment.
Skin assessments and recommendations are for cosmetic and informational purposes only and are not a substitute for professional medical care. AI skin analysis may be less accurate for some skin tones, lighting conditions, camera qualities, and devices. Do not rely on the App to detect, diagnose, or treat any skin disease or medical condition.
Always seek the advice of a qualified healthcare professional (such as a physician or dermatologist) with any questions about a medical condition, and never disregard or delay seeking professional medical advice because of something you read or received in the App. If you think you may have a medical emergency, contact emergency services immediately.
Skincare products and ingredients can cause reactions. You are responsible for reviewing product labels and patch-testing as appropriate. If you are pregnant, nursing, or have a known skin condition or allergy, consult a healthcare professional before following any recommendation. The pregnancy-safe routing in the App is a convenience feature and is not a substitute for medical guidance.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate information and keep it up to date. Notify us promptly at privacy@camellialabs.com if you suspect unauthorized use of your account.
Your use of the App involves the collection and processing of personal and health-related information, as described in our Privacy Policy and Consumer Health Data Privacy Policy. Before any photo is taken, we present a separate, standalone consent screen describing how your photo and any facial geometry are handled and how your photo is shared with our AI analysis provider. You must provide explicit, opt-in consent before a photo is collected and a separate consent before it is shared with our AI provider. You may withdraw consent and request deletion at any time as described in those policies.
Photo handling. Your photo is stored in your account for progress tracking until you delete it or close your account (persistent storage). The applicable approach is described in the Privacy Policy, the Consumer Health Data Privacy Policy, and the Biometric Data Retention and Destruction Policy, which govern in case of any conflict with these Terms.

The App, including its software, design, text, and AI-generated outputs, is owned by Camellia Labs or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms. You retain ownership of the photos and content you provide. By uploading content, you grant us a limited license to process and store it solely to provide the App’s features to you, as described in our privacy policies. We do not use your photos to train AI models.
The App relies on third-party providers, including AI analysis providers, to deliver its features. Your photo is transmitted to these providers solely to produce your skin assessment, under written agreements that prohibit retention beyond what is necessary, model-training use, sale, or further sharing. We are not responsible for the independent practices of third parties except as set out in our agreements with them and our privacy policies.
The App is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that assessments will be accurate or suitable for your needs. As stated in Section 4, the App does not provide medical advice.
To the fullest extent permitted by law, Camellia Labs and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the App. To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the App will not exceed the greater of the amount you paid us in the twelve months before the claim or$100. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to indemnify and hold harmless Camellia Labs from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the App, your violation of these Terms, or your violation of any law or third-party right.
You may stop using the App and close your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the App or other users. On termination, we will delete your data as described in our Privacy Policy and Consumer Health Data Privacy Policy. Provisions that by their nature should survive termination (including Sections 8, 10, 11, 12, 15, and 16) will survive.
We may modify the App or these Terms from time to time. When we make material changes to these Terms, we will update the “Last updated” date and notify you within the App or by email before the changes take effect, as required by law. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree, stop using the App.
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules, except where preempted by federal law.
These Terms, together with the policies they incorporate, are the entire agreement between you and Camellia Labs regarding the App. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
